The complaint alleges the following violations of Minnesota cannabis regulations:
Product Substitution: Gummies formulated for the Minnesota market (5mg delta-9 THC, 0mg CBD) were packaged into bags labeled for North Dakota (5mg delta-9 THC, 75mg CBD) and sold through retail locations in North Dakota, constituting misbranding and potential consumer harm.
COA Fraud: Certificates of Analysis provided to retailers and regulators were outdated, misapplied to different product lots, or adjusted to create the appearance of compliance with regulatory testing requirements.
Unsanitary Packaging: THC edibles were manually packaged and heat-sealed at an office location (10740 Lyndale Avenue, Suite 11W, Bloomington, MN) without proper sanitation controls, including absence of glove use, handwashing facilities, or surface sanitization.
Unlicensed Manufacturing: Manufacturing and packaging operations were conducted without evidence of the required OCM licensure for the activities performed.
